Taney County race track developer waits on appeals process after approval vote

A hearing is scheduled before the Taney County Board of Adjustment on Nov. 16.

FORSYTH, Mo. -- Taney County Planning and Zoning Administrator Bob Atchley says there has been one appeal filed against the Planning and Zoning Commission's vote on July 18 in favor of the Branson Sports Entertainment Complex -- the proposed NASCAR-style race track.

The appeal process allows 90 days from the date of the decision for the public to speak up.  A hearing on any appeal will be held in front of the Taney County Board of Adjustment on Nov. 16, Atchley says.

Atchley says developer Russell Cook has a 75-acre land grading permit and put down a $56,250 land reclamation bond, in case the county needs to restore the land.  Cook applied for an additional 325-acre land grading permit but it’s not yet approved.  Cook will need a $243,750 land reclamation bond for that permit.

After the hearing in November, folks in Taney County could even ask for a rehearing, and anything after that would have to be through the circuit court.

Branson Sports Entertainment Complex spokesman Nathan Adams says they are waiting on the appeal process and the additional land grading permit before any additional work will be done on the site.  No work has been done since June.

Adams thinks things will still move forward in Taney County despite the appeal.  He said Branson Sports Entertainment Complex developers are continuing the exploration process for an alternative site that they began in Arkansas, just in case Taney County doesn't work out.

The Missouri Department of Natural Resources sent a letter, saying it appears the developer has cleared more land than he has a permit to clear.  Adams says BSEC does not face any fines or penalties from DNR.
